  What's needed for a
successful program?
TX Agriculture Code Chapter 16 Fuel Ethanol and Biodiesel Production Incentive Program passed in 2003 defined biodiesel as meeting PS 121, the provisional specification for biodiesel. In May 2009, HB 2582 revised Chapter 16 to define biodiesel meeting ASTM D 6751. It authorized a net .168 per gallon incentive for biodiesel producers up to a max of $3.024M per producer per year. Because greater than 2/3 of senators and representatives voted for the bill it became effective on May 31, 2009.

Section 16.001, Agriculture Code, is amended to read Biodiesel" means a motor fuel that meets the registration requirements for fuels and fuel additives established by the EPA under Section 211 of the federal Clean Air Act (42 U.S.C. Section 7545)as mono-alkyl esters of long chain fatty acids derived from vegetable oils and animal fats and meets the requirements of ASTM specification D-6751.
